Article 1 - Objet :

• " The existing general sales conditions define the terms and conditions in which any individual - French citizen or foreign- orders and purchases the products available to sale by the "Limited Company Skin Progress" via its website: www.skinprogress.com.
• Being a contract closed from a distance via electronic communication, the " Limited Company Skin Progress" introduces itself to its customers:

Article 2 - Acceptance of general sales conditions

• A customer filling out and validating the invoice featured on the website is worth complete and full acceptance of the following general sales conditions. The general sales conditions will be enforceable to the closed contract and can be examined by the customer at any time, simply by clicking on the "General terms" section.

Article 3 - Features of goods and available services

• Selected and available to sale products by the "Limited Company Skin Progress" are representative of the beauty product universe, care or well-being, from around the world.
• The " Limited Company Skin Progress " acknowledges the customer of all essential features of its products. In general terms, these features may concern the size, weight, quantity, colors or the constitution of sold products. These features are illustrated with a picture revealing the offer. The customer acknowledges the picture illustrating the product on the website is of indicative value, visual features are proned to fluctuations from one product to another.

Article 4 - Prices

• The currency in which products are sold is the Euro, they are displayed all taxes included. Sale prices are subject to change. The sale price charged matches the one displayed on the website when the order was being registered. Shipping fees for France are to be added to the sale price of products, except for mentions claiming the contrary on the website.

Article 5 - Order

• The customer places an order to the limited Company Skin Progress " by filling out his one's "basket" on the website. After having validated his order, the customer must identify himself, pass on and pay his order. Once accepted, his order will be confirmed via e-mail.

5.1. Order validation

• The customer chooses the products he wishes to purchase, confirms his purchase after having checked his "basket" displayed on screen.
• The recap indicates:
  - The specifications of the selected products, their references and unit price
  - Shipping fees
  - Total price to be paid by the customer

5.2. Customer identification

• After having validated his order, the customer must identify himself. Thereby, he must fill out a form available to him, on the website. He will indicate first and last name, e-mail address, postal code (shipping address if different), and phone number (and number of recipient if different).
• The " Limited Company Skin Progress " allows itself the right to verify the accuracy of any information entered by the customer, and notably his identification and address prior to shipping ordered products.

5.3. Payment

• The customer permanently validates his order by entering his credit card number and his expiration date. Payments by credit card are secured by an online payment system SSL certified.

5.4. Confirmation of order

• To make sure of the customer's willingness, the "Limited Company Skin Progress" commits itself to confirm all purchases via e-mail in the 24 hours following the receipt of the order. On that confirmation will appear the listing of the ordered product, its price and the chosen method of payment.
• The confirmations will be archived in the buildings of the "Limited Company Skin Progress" and will remain proof of the nature of the agreement and its date.

Article 6 - Payment conditions

• - Products are payable via credit card, on the day of the purchase.
• Accepted card by the "Limited Company Skin Progress" are the ones holding the logos CB, VISA or EUROCARD/MASTERCARD. Payments by credit card are secured by an online payment system SSL certified.
• The order validated by the customer will be considered effective by the "Limited Company Skin Progress" only when payment centers will have given their approval. In case of refusal, the order will automatically be revoked and the customer warned via e-mail or letter.
• Also, the "Limited Company Skin Progress" allows itself the right to revoke any order with a customer with whom litigation would exist

Article 7 - Delivery

• The "Limited Company Skin Progress" accepts the order and begins delivery operations, at payment reception.
• Ordered articles will be sent at the place of residence of the buyer or any other address indicated at the moment of the purchase. Delivery (first appearance at the delivery address) is insured by "La Poste" via Colissimo for Metropolitan France or via DHL for outside of Metropolitan France.
• The "Limited Company Skin Progress" engages itself to deliver the products within 7 days maximum after order registration (except in the case of products requiring an extension: this extension is then indicated on the product's file). If the item is unavailable, the customer will be informed the earliest possible and will be able to revoke his order. He will then be able to demand an exchange or reimbursement.
• During delivery, the customer will check the overall aspect of the packing and the delivered products. In case of damage, spoilage or missing products, the customer must formulate his complaint in writing on the delivery slip and confirm his comments to the "Limited Company Skin Progress" by certified mail and by e-mail 24 hours upon delivery maximum. Any complaint must be sent to the address enounced in Article 1.

Article 8 - Warranties and right of revocation

• In compliance to the arrangements of the article L.121-16 du Code de la Consommation, the customer has 7 days to return the ordered product so as to obtain exchange or reimbursement, new shipping fees being at his expense. To demand exchange or reimbursement it will have to be transmitted to the "Limited Company Skin Progress" via a confirmed e-mail within 24 hours by certified mail with delivery slip to the indicated address at article 1.
• The returned product will imperatively have to be in his genuine packing, which must be unimpaired, and accompanied with all possible accessories, instructions, documentation. The "Limited Company Skin Progress" is held responsible of legal guaranty of depraved evils, referring to the article 1641 of the Civil code that states "the seller is responsible of reimbursement in case of depraved evils, rendering the product unfit to the use it is destined to, or that it reduces its use so much, the buyer would have not made the purchase, or paid a lesser price, had he known them.

Article 9 - Nominative information

• The nominative information gathered on the website is vital to the processing and transporting of orders and billing establishment. However, they will be of use and will be subject to outside communication solely for management needs or to satisfy legal and regulation requirements.
• In compliance to the "Informatique et Libertés" law, January 6th 1978, the processing of nominative information relative to customers of the "Limited Company Skin Progress" has been subject to a declaration to the Commission Nationale de l'Informatique et des Libertés (CNIL).
• Also, the customer has a right to access his own information and rectify it on the company files. He will be able to carry out this right by writing to the address indicated in Article 1.

Article 10 - Retention of titles

• The " Limited Company Skin Progress " keeps the right on ordered products until the payment is made full and effective. If, for any reason whatsoever, the product is delivered to the customer, him not having paid for it, the " Limited Company Skin Progress " could recapture possession of the product.

Article 11 - Competent jurisdiction

• The existing general sales conditions are subject to the enforcement of the French law. If litigation were to appear from the present contractual relationship, the parties engage prior to any judiciary to find an amicable solution.
• Parties agree that litigation born from the present contract results from the jurisdictions of Nantes (France) only.
